Please read these Terms of Service (“Terms”) carefully before using mocoche.com (the “Site”) or purchasing any products from Mocoche (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility
By using this Site, you represent that you are at least 18 years of age, or that you are at least 13 years of age and have the consent of a parent or legal guardian. You agree to use the Site only for lawful purposes and in accordance with these Terms.
3. Products and Pricing
Product Descriptions
We make every effort to display our products and their colours, dimensions, and descriptions as accurately as possible. However, because our products are handcrafted from natural materials, slight variations in colour, size, texture, and pattern are inherent to each piece and are not considered defects. These variations are part of what makes each item unique.
Pricing
All prices are listed in Canadian dollars (CAD) unless otherwise stated. We reserve the right to change prices at any time without prior notice. Prices in effect at the time your order is placed will apply to that order. We are not responsible for typographical errors in pricing, and we reserve the right to cancel any order placed at an incorrect price.
Availability
All products are subject to availability. We reserve the right to limit quantities or discontinue products at any time. If a product you ordered is out of stock, we will notify you and offer a refund, substitution, or backorder option at your discretion.
4. Orders and Payment
Order Acceptance
Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion. An order is confirmed when you receive an order confirmation email from us. We reserve the right to cancel orders due to pricing errors, suspected fraud, stock unavailability, or other reasons, and will provide a full refund in such cases.
Payment
We accept payment via the methods displayed at checkout (which may include credit card, debit card, and PayPal). All payments are processed securely through our payment processors. We do not store your full payment card details on our servers. By placing an order, you represent that you are authorized to use the payment method provided.
Taxes
Applicable Canadian federal and provincial taxes (GST/HST/PST) will be added to your order at checkout where required by law. You are responsible for any import duties, customs fees, or taxes imposed by your country if ordering from outside Canada.
5. Shipping and Delivery
We ship primarily within Canada and may ship internationally at our discretion. Shipping costs and estimated delivery times are displayed at checkout and may vary by location, carrier, and order size.
We are not responsible for delays caused by shipping carriers, customs clearance, weather events, or other circumstances beyond our control. Risk of loss and title for products pass to you upon delivery to the shipping carrier. If your order is lost or damaged in transit, please contact us at sales@mocoche.com and we will work with you to resolve the issue.
For international orders, you are responsible for complying with all applicable import laws and paying any duties or taxes imposed at the border.
6. Returns and Refunds
We want you to love your Mocoche purchase. If you are not satisfied, please contact us within 30 days of delivery to request a return or exchange.
Eligibility for Returns
- Items must be unused, unworn, and in their original condition and packaging
- Items must be returned within 30 days of the delivery date
- Proof of purchase (order number or receipt) is required
- Sale items and custom or personalized orders are final sale and not eligible for return
Return Process
To initiate a return, email us at sales@mocoche.com with your order number and reason for return. Do not send items back without first contacting us. You are responsible for return shipping costs unless the item was defective or we made an error.
Refunds
Once we receive and inspect your return, we will notify you of the approval or rejection. Approved refunds will be processed to your original payment method within 5–10 business days. Original shipping charges are non-refundable unless the return is due to our error or a defective product.

The Site and its content are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Site.
To the extent permitted by applicable Canadian law, we disclaim all warranties. Nothing in these Terms limits any rights you may have under applicable consumer protection legislation that cannot be excluded by contract.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Mocoche and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Site or our products, including but not limited to loss of profits, loss of data, or loss of goodwill.
Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to us for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full. Nothing in these Terms limits liability for death, personal injury, fraud, or any other liability that cannot be excluded under applicable law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Mocoche and its owners, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to us.

14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the courts of competent jurisdiction in Ontario, Canada. You agree to submit to the personal jurisdiction of such courts.
If you are a consumer resident of Quebec, nothing in these Terms limits your rights under the Consumer Protection Act (Quebec).
15. Consumer Protection Rights (Canada)
Nothing in these Terms is intended to limit any rights you have under applicable Canadian consumer protection legislation, including but not limited to provincial consumer protection acts. If any provision of these Terms conflicts with mandatory consumer protection rights, those rights prevail.
Canadian consumers have statutory rights regarding product quality and fitness for purpose that cannot be excluded by contract. These Terms do not affect those statutory rights.
16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the “Last updated” date at the top of this page. For material changes, we may also notify you by email or by posting a prominent notice on the Site.
Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
17. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and Mocoche with respect to your use of the Site and supersede all prior agreements and understandings.
